TERMS OF SERVICE

THE COMMERCIAL CLASS

TERMS OF SERVICE FOR AUDITION CLASSES IN COMPLIANCE WITH CALIFORNIA LABOR CODE §§ 1701, et seq.

These Terms of Service apply to participation in Talent Training Services (as defined in California Labor Code §§ 1701, et seq. ) provided by The Commercial Class, and the terms hereof are in compliance with such statute.  These Terms of Service shall be governed by and construed in accordance with California Labor Code §§ 1701, et seq.

By accessing or using our website/service, you agree to be bound by these Terms of Service, which constitute a legally binding contract between you (“Artist”) and The Commercial Class.  Please read these terms carefully as they outline your rights and responsibilities regarding your use of our website/service.

The services to be performed by The Commercial Class shall include the following services:

  • Intro to Commercial Audition Technique ($325 per student)
  • Advanced Commercial Audition ($350 per student)
  • Improv for Commercials Audition ($350 per student)
  • Kid/Parent Intensive Weekend Workshop ($300 per student)
  • Advanced Commercial Technique for Actors 50+ ($350 per student)
  • Headshot Workshop with Maya Adrabi ($150 per student)

The specific service is indicated by the class(es) the Artist chooses on the website.  Fees must be paid at Check Out on the website before the class begins.

The duration of this contract is from the date of purchase until one (1) year from such date, with no automatic renewal.

The Commercial Class is in compliance with the bonding requirement of Chapter 4.5:

Bond# 71871267, Western Surety Company. 

A bond in the amount of fifty-thousand dollars ($50,000) must be posted with the California Labor Commissioner.

THE COMMERCIAL CLASS IS A TALENT TRAINING SERVICE. THIS IS NOT A TALENT AGENCY CONTRACT. ONLY A TALENT AGENT LICENSED PURSUANT TO SECTION 1700.5 OF THE LABOR CODE MAY ENGAGE IN THE OCCUPATION OF PROCURING, OFFERING, PROMISING, OR ATTEMPTING TO PROCURE EMPLOYMENT OR ENGAGEMENTS FOR AN ARTIST.

THE COMMERCIAL CLASS IS PROHIBITED BYLAW FROM OFFERING OR ATTEMPTING TO OBTAIN AUDITIONS OR EMPLOYMENT FOR YOU. IT MAY ONLY PROVIDE YOU WITH TRAINING.

FOR MORE INFORMATION, CONSULT CHAPTER 4.5 (COMMENCING WITH SECTION 1701) OF PART 6 OF DIVISION 2 OF THE LABOR CODE.

A DISPUTE ARISING OUT OF THE PERFORMANCE OF THE CONTRACT BY THE TALENT SERVICE THAT IS NOT RESOLVED TO THE SATISFACTION OF THE ARTIST SHOULD BE REFERRED TO A LOCAL CONSUMER AFFAIRS DEPARTMENT OR LOCAL LAW ENFORCEMENT, AS APPROPRIATE.

YOUR RIGHT TO CANCEL

You may cancel this contract and obtain a full refund, without any penalty or obligation, if notice of cancellation is given, in writing, within 10 business days from the above date or the date on which you commence utilizing the services sunder the contract, whichever is longer. For purposes of this section, business days are Monday through Friday.

To cancel this contract, mail or deliver or send by facsimile transmission a signed and dated copy of the following cancellation notice or any other written notice or cancellation to THE COMMERCIAL CLASS, at 200 South La Brea, Los Angeles, CA 90036/ l020 N. Sycamore Avenue, Los Angeles, CA 90038, 323-330-1020, fax number 323-874-6330, email address Classes@thecommercialclass.com, and Internet website address www.thecommercialclass.com. NOT LATER THAN MIDNIGHT OF THE 10TH BUSINESS DAY AFTER THE SIGNATURE DATE ABOVE OR THE FIRST CLASS THAT YOU ATTEND, WHICHEVER IS LATER.

If you cancel, all fees you have paid must be refunded to you within 10 business days after delivery of the cancellation notice to the talent service. Cal. Labor Code § 1703(a)(1)-(6). 

NO REFUND MAY BE OBTAINED AFTER THE 10-DAY CANCELLATION PERIOD.
